Is Delta 8 THC Legal in Indiana?

Yes, delta 8 THC is legal in Indiana. The state hasn’t explicitly legalized the compound, but it also hasn’t banned its use. 

Indiana legalized hemp in 2018 when Governor Eric Holcomb signed Senate Bill 52. This bill allows the use and sale of cannabidiol (CBD) in multiple forms so long as the products contain less than 0.3% delta 9 THC. There are restrictions regarding the packaging of CBD products in the Hoosier State. 

Products are allowed for sale if the packaging includes a QR code that links to information like product batch number, batch size, list of ingredients and number of milligrams of CBD, a Certification of analysis, etc. Though Indiana was notoriously against cannabis legalization, products like hemp-derived foods, beverages, cosmetics, and even smokables can be legally sold in the state.  

In 2019, shortly after the passage of the 2018 Farm Bill, the Governor signed Senate Bill 516. This bill further aligned hemp laws with federal laws and created a regulatory framework for the cultivation and production of hemp within the state. 

What Does the Future Hold?  

Indiana is one of the few states without a medical marijuana program. This makes it likely that the Hoosier State will ban the manufacture and distribution of this compound. However, things could go in a different direction, and the state may choose to legalize or regulate THC from hemp.

Most delta 8 products on the market are made from isomerized hemp-derived CBD. This means that this cannabinoid is not extracted directly from the hemp plant, but there’s a lab method involved in its creation. The process of isomerization could serve as the ground for the DEA to claim ∆8-THC as “synthetic.” 

There are products on the market that use naturally-derived ∆8-THC. When derived directly from hemp, this cannabinoid falls under the 2019 Farm Bill. Regardless of its intoxicating nature, if a product contains less than 0.3% delta 9 THC, it’s legal on a federal level.
