The FDA recently issued a warning to consumers regarding the use of this cannabinoid. 

The state holds close to the FDA guidelines in regards to adding cannabidiol (CBD) to food and beverages. But, the federal status of these two cannabinoids is entirely different because CBD is an already approved epilepsy drug, which makes things more complicated for this compound. 

For now, it seems that the federal agency is tolerating brands who sell this compound, as long as they are not making any medical claims or offering it as a dietary supplement. 

What Does the Future Hold?

Is Delta 8 THC Legal Federally?

There’s not a single stance of the legality of delta 8 on a federal level. 

In a letter to the Alabama Board of Pharmacy in September 2021, the Drug Enforcement Administration (DEA) clarified the control status of Δ8-THC by stating the following:  

“Cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

This means that delta 8 that naturally occurs in the hemp plant is not a controlled substance. However, most Δ8-THC comes from the conversion of hemp-derived cannabidiol (CBD), which raises questions about the nature of this compound. 

In regards to that, the DEA stated that THC is controlled when “synthetically produced from non-cannabis material.” In essence, delta 8 is made from CBD, but the chemical conversion also includes non-cannabis materials like solvents. 

Because both cannabis and non-cannabis materials are involved, Δ8-THC may be considered a semi-synthetic compound. This leaves space for the DEA to ban it, which according to experts, is unlikely. The DEA hasn’t approached delta 8 with a ban despite all the controversy. 

Although not prohibited federally, this cannabinoid is banned or restricted in many states. Vendors use it in food and beverages without it being an FDA-approved food additive. And the FDA is not close to legalizing this compound, given its recent warning to consumers.
