The letter simply states: “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

This statement aligns with federal law but doesn’t necessarily address the true nature of delta 8. Most Δ8-THC is synthesized from CBD, which is a hemp-derived cannabinoid. In addition, the letter states that delta 8 is considered illegal when it’s “synthetically produced from non-cannabis material.” 

As you may notice, this substance falls somewhere between synthetic and natural because it’s a mix of cannabis and non-cannabis ingredients. That said, the DEA hasn’t explicitly banned or restricted the sale and distribution of this compound that has been around for two years.

The same goes with the Food and Drug Administration, which recently released a warning letter to consumers about the dangers of this unregulated substance. These actions don’t solve the availability of low-quality, harmful delta 8 THC products.
