Delta 8 THC is likely legal in Nebraska. The state is known for its strict cannabis laws but hasn’t imposed restrictions on delta 8. 

It’s challenging to determine the legal status of delta 8 in Nebraska because the state is one of the few in the nation where cannabis has been legal for limited hemp-farming purposes. 

The state legalized the plant in 2019 with the Nebraska Hemp Farming Act and aligned the state definition of hemp with the federal one. Products derived from hemp with less than 0.3% delta 9 are legal in Nebraska because they are legal under federal law. 

The Cornhusker State has adopted the same language as used on the federal level, so hemp-derived Δ8-THC products with less than 0.3% delta 9 are legal until further notice. 

In the summer of 2021, Attorney General Dough Peterson was asked to review whether Δ8-THC falls within the state’s definition of marijuana, but no answer has been provided. So, vendors continue to sell this cannabinoid without hurdles.

The industry has been seeking answers from federal agencies regarding the legality of this substance. Recently, as a response to the Alabama Board of Pharmacy, the Drug Enforcement Administration (DEA) sent a letter explaining the legal status of this compound. 

Some of the things in that letter create confusion because the DEA doesn’t clearly state whether this compound is considered “synthetically derived” THC or not. The letter simply states: “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

This statement aligns with federal law but doesn’t necessarily address the true nature of delta 8. Most Δ8-THC is synthesized from CBD, which is a hemp-derived cannabinoid. In addition, the letter states that delta 8 is considered illegal when it’s “synthetically produced from non-cannabis material.” 

As you may notice, this substance falls somewhere between synthetic and natural because it’s a mix of cannabis and non-cannabis ingredients. That said, the DEA hasn’t explicitly banned or restricted the sale and distribution of this compound that has been around for two years.

The language of the letter seems to suggest that this cannabinoid is legal because it’s made from hemp and contains less than 0.3% delta 9 THC. The same goes with the Food and Drug Administration, which recently released a warning letter to consumers about the dangers of this unregulated substance. These actions don’t solve the availability of low-quality, harmful delta 8 THC products.
