Is Delta 8 THC Legal in New Jersey?

Yes, delta 8 THC is legal in New Jersey. The state hasn’t legalized this compound explicitly,  but it also hasn’t banned its use. 

Delta 8 is a hemp derivative that’s legal in New Jersey and under the 2018 Farm Bill. As a naturally occurring cannabinoid in hemp, ∆8-THC is federally legal. It can be produced, distributed, and sold for consumption in products with no more than 0.3% delta 9 THC if extracted from hemp.  

Because New Jersey’s hemp law accepted the federal definition of hemp — and hasn’t banned or restricted the sale of this cannabinoid — you can lawfully buy it if you live in the Garden State. 

There’s a gray area around this cannabinoid because it’s produced using hemp-derived cannabidiol (CBD). Many states have decided to deal with the uncertainty by either legalizing this cannabinoid as part of their recreational cannabis system or restricting and banning sales. 

As of this writing, New Jersey isn’t on the list of states that bans or restricts the sale, distribution, and consumption of any hemp cannabinoid, except for delta 9 THC. Delta 8 is not a controlled substance in the Garden State, but we should continue to follow future changes.    

What Does the Future Hold?  

New Jersey has a medical marijuana program and is in the process of setting up rules for the legalization of recreational cannabis. Like many states, New Jersey may ban, restrict, or legalize ∆8-THC products as part of its recreational cannabis system. 

It’s unlikely that we’ll see this compound getting outlawed in the Garden State. The most likely outcome is that it will be regulated in a similar way to medical or recreational marijuana. 

Is Delta 8 THC Legal Federally?

In August 2020, the Drug Enforcement Administration (DEA) published an Interim Rule on hemp and hemp derivatives. A year after its enactment, questions around the legality of ∆8-THC remain. 

The 2018 Farm Bill removed hemp and tetrahydrocannabinols contained in hemp from the definition of “marijuana” and the Controlled Substances Act. In the definition of “hemp,” the farm bill includes “all derivatives, extracts, cannabinoids, isomers” with a delta 9 THC concentration of less than 0.3% by dry weight. 

Because hemp derivatives like ∆8-THC are not considered “marijuana,” they fall outside the DEA’s authority. Accordingly, when it’s derived from hemp and not marijuana, it is considered a legal substance under the farm bill. 

The issue arises in the case of delta 8 being a potentially synthetic substance. The Farm Bill doesn’t change the scheduling of synthetic cannabinoids, which are illegal federally. 

Because ∆8-THC is present in low concentrations of less than 0.1% in hemp, manufacturers isomerize it from hemp CBD. Obtaining it through this method of chemical synthesis may be a base for the substance to be labeled “synthetic” by the DEA. 

Clarification over this entire complicated situation is needed. Until the DEA provides it, ∆8-THC remains in a legal gray area federally.
