Is Delta 8 THC Legal in Oklahoma?

Oklahoma was close to banning Δ8-THC by including it into the definition of “marijuana” in their new medical cannabis bill. The new law was signed by Governor Stitt in May 2021 and excluded (previously planned) delta 8 and delta 10 THC from the definition of marijuana.

For now, hemp-derived delta 8 THC is legal (but unregulated) in the Sooner State. 

Oklahoma legalized hemp and hemp-derived products with less than 0.3% delta 9 THC under House Bill 2145. The bill removed hemp CBD from the definition of marijuana and set licensing requirements for entities selling these products. The only thing is, you have to be 21 to consume this substance legally.

Is Delta 8 THC Legal Federally?

Delta 8 THC is legal federally, thanks to the 2018 Farm Bill. Although some states have outlawed it, and others restricted it, it remains in a gray legal area on a federal level. This cannabinoid is 100% legal when extracted directly from the hemp plant. But, in hemp, it’s present in extremely low concentrations, which makes extraction not financially viable. 

To obtain it in larger concentrations, makers use hemp-derived cannabidiol (CBD) and, with the help of solvents, convert it into Δ8-THC. Because this substance is produced by combining cannabis and non-cannabis ingredients, it’s likely a semi-synthetic compound. 

There’s no definition that clarifies the legality of this substance. The Farm Bill of 2018 doesn’t affect the control status of “sytnethcially derived cannabinoids,” which remain illegal under federal law. But, delta 8 made from CBD doesn’t seem to fit entirely into the “natural” or “synthetic” category.

When the Farm Bill legalized hemp, it carved out “tetrahydrocannabinols in hemp” from the list of controlled substances. But, the bill doesn’t affect the legal status of “synthetic” cannabinoids. And because Δ8-THC is semi-synthetic, it may be deemed illegal by the DEA – which hasn’t happened yet. 

In a letter to the Alabama Board of Pharmacy, the DEA clarified that for a cannabinoid (including delta 8) to be considered a controlled substance, it must be “synthetically produced from non-cannabis material.” Because Δ8-THC has CBD as its main ingredient, it falls in a gray legal area federally and remains unregulated.
