The passage of the 2018 Farm Bill, or the Agriculture Improvement Act, carved out a path for legalization of this cannabinoid by excluding “tetrahydrocannabinol in hemp” from the list of controlled substances. 

The US Cannabis Council and the Foundation of Cannabis Unified Standards both disagree that a loophole exists. Their official statement is that an intoxicating cannabinoid cannot become legal simply based on being derived from a hemp compound. The main complaint here is that this cannabinoid is intoxicating and not extracted from the plant directly but synthesized from cannabidiol (CBD).
