Is Delta 8 THC Legal in Alabama?

Yes, ∆8-THC derived from hemp is legal and readily available in the Cotton State. The state was on the verge of banning this compound but decided against it. 

Despite attempts to ban it, this cannabinoid remains legal in Alabama. In April 2021, the future of delta 8 and delta 10 in the Cotton State looked hopeless. 

The Alabama Senate was about to pass House Bill 2, which would originally prohibit the use of an addictive opiate. Then, the Senate Judiciary Committee added the amendment that would place delta 8 and delta 10 on the list of controlled substances as well. 

Luckily, the amendment was not voted out by the House Health Committee, so these two THC variants remain legal in this state. 

What Does the Future Hold?  

Given the previous history of attempts to ban addictive or intoxicating substances like delta 8 and delta 10, there’s no guarantee that Alabama won’t introduce similar legislation in upcoming sessions. 

Also, the state is in the last (ish) batch of states to legalize medical marijuana. So far, 37 states have legalized medical marijuana, and many are in the process of considering its legalization. In reality, Alabama has nurtured a friendly attitude towards hemp and hemp-derived products, but we’ll see what the future holds for ∆8-THC.

Is Delta 8 THC Legal Federally?

When the 2018 Farm Bill legalized hemp, it also excluded the plant and its derivatives, extracts, and cannabinoids from the controlled substances list — including “THC in hemp.” As you know, ∆8-THC is naturally present in the hemp plant but not in “extractable concentrations.” 

So, manufacturers have found a way to obtain large quantities of this compound by synthesizing it from hemp-derived cannabidiol (CBD). This means that the ∆8-THC infused in products is not extracted directly from the hemp plant, like CBD — which creates bases for the compound to be deemed “non-natural” or “synthetic.” 

The Drug Enforcement Administration (DEA) touched base on “synthetically derived cannabinoids” in their Interim Rule. It confirmed that they are illegal and that the 2018 Farm Bill doesn’t affect the scheduling of a substance deemed a synthetic derivative. 

It doesn’t help that federal law hasn’t clearly defined synthetic derivatives, which creates a loophole under the Farm Bill, considering this compound is made from hemp. 

The question of delta 8 as a potentially synthetic derivative is up for debate, so its legal status is murky. Another hurdle on the way to legality of this compound is that it’s intoxicating. 

Regarding this question, the US Cannabis Council argues that there’s no loophole. They stated that “the 2018 Farm Act does not legalize the production of psychoactive drugs simply because the base material has been extracted from industrial hemp, and the DEA’s current rulemaking clearly confirms this position.”

Is the DEA after hemp-derived delta 8 THC? Yes, but states have also accepted this cannabinoid and allow businesses to sell without restrictions. Also, it seems unlikely to see a federal ban on this compound because everything points out to federal legalization of cannabis.
