Is Delta 8 THC Legal in South Carolina?

In 2019, the state passed the South Carolina House Bill 3449. This bill legalized hemp and hemp-derived compounds, including Δ8-THC. It aligns with the federal Farm Bill, which classifies hemp as an agricultural product and legalizes farming, production, and extraction in the US.

Is Delta 8 THC Legal Federally?

Hemp-derived Δ8-THC has been hitting the shelves under minimal regulatory guidance for two years. Its legality has states, distributors, and manufacturers confused. Under the Farm Bill of 2018, Δ8-THC is 100% legal on a federal level if directly extracted from hemp. 

But, because the hemp plant produces low concentrations of this cannabinoid, natural extraction is difficult and financially burdensome. So, manufacturers create this substance in a lab. The issue here is the legal status of Δ8-THC made through isomerization from hemp-derived cannabidiol (CBD). 

Most Δ8-THC on the market is made by blending cannabis (hemp-derived CBD) and non-cannabis materials (solvents). This puts the substance in a gray legal area, and so far, this hasn’t been addressed by federal agencies. 

In a recent advisory letter to the Alabama Board of Pharmacy, the DEA stated that a cannabinoid is considered illegal when it’s “synthetically produced from non-cannabis material.” The letter doesn’t address the true nature of Δ8-THC made from non-cannabis and cannabis materials. As a semi-synthetic compound, this substance falls in a gray legal area and remains unregulated on a federal level.
