Is Delta 8 THC Legal Federally?

There’s no definitive answer to the question of the legality of delta 8 THC derived from cannabidiol (CBD) on a federal level. The Farm Bill of 2018 legalized the distribution, sale, and consumption of hemp (and hemp-derived products) with a delta 9 concentration of no more than 0.3%. 

The bill defined hemp and marijuana separately and removed “tetrahydrocannabinols in hemp” from the list of controlled substances. As a result, all cannabinoids, including Δ8-THC, that naturally occur in the hemp plant are considered legal. 

The issue is, there’s no clear definition regarding the legality of Δ8-THC made from hemp-derived cannabidiol (CBD). Most Δ8-THC on the market is made from hemp CBD and solvents in a lab, which makes this substance semi-synthetic at best. 

A recent advisory letter by the DEA stated that cannabinoids like Δ8-THC are considered illegal when “synthetically produced from non-cannabis material.” As you can notice, this is problematic because delta 8 seems to fall in between synthetic and natural. For this compound to be deemed illegal, a clear definition and legislation should be released. 

For now, Δ8-THC exists in a gray legal area federally. There’s a pressing need to regulate this cannabinoid on a federal level, but, for now, each state is taking the initiative to legalize, ban, or restrict this substance properly.
