The amendments noticeably differentiated “hemp” from “marijuana.” According to the Controlled Substances Act (CSA), an exception was made for hemp and its derivatives. 

What Does the Future Hold?

Is Delta 8 THC Legal Federally?

There’s no clear answer when it comes to the legality of Δ8-THC on a federal level. That is when talking about the legal status of Δ8-THC made from hemp cannabidiol (CBD). 

The 2018 Farm Bill legalized the sale, distribution, and consumption of hemp and hemp-derived cannabinoids. Under the bill, all tetrahydrocannabinols that naturally occur in hemp are legal — except for delta 9 THC, allowed in a concentration of less than 0.3% by weight. 

The bill makes a clear difference between hemp and marijuana and removes “tetrahydrocannabinols in hemp” from the list of controlled substances. Meaning, Δ8-THC that naturally occurs in the hemp plant is legal under federal law, as confirmed in a recent DEA advisory letter to the Alabama Board of Pharmacy. 

The letter states that Δ8-THC is considered illegal when “synthetically produced from non-cannabis material.” But, because this substance is found in low levels in the hemp plant, manufacturers craft it in a lab using both cannabis (CBD) and non-cannabis (solvents) ingredients. 

Judged by this, Δ8-THC is semi-synthetic and falls in a gray legal area that remains unaddressed by federal agencies. Due to a lack of regulations around delta 8, states decided to restrict or ban its sale within their borders.
