Delta 8 THC derived directly from hemp is legal under the 2018 Farm Bill. The bill legalized the sale, distribution, and consumption of hemp and hemp-derived products with no more than 0.3% delta 9 for commercial purposes. It also removed “tetrahydrocannabinols in hemp” from the list of controlled substances and made a clear distinction between hemp and marijuana. 

But, because this substance is found in low concentrations in hemp, its extraction from the plant is not financially viable. So, makers create it in a lab from hemp-derived CBD and solvents. In a letter addressed to the Alabama Board of Pharmacy, the DEA confirms the legality of naturally extracted, hemp-derived Δ8-THC

However, it states that this substance is considered illegal when “synthetically produced from non-cannabis material.” The thing is, makers combine cannabis and non-cannabis ingredients when crafting it from CBD. At best, it’s considered semi-synthetic. 

The semi-synthetic nature of this cannabinoid creates confusion and gives space to the DEA to deem it illegal. For now, Δ8-THC made from hemp CBD falls in a gray legal area federally.
