Is Delta 8 THC Legal in Arizona?

Delta 8 THC is illegal in Arizona. Under Arizona law, all forms of tetrahydrocannabinol are prohibited, including delta 8. 

Thanks to the Farm Bill of 2018 and state laws, hemp-derived products are fully legal in Arizona. But, the Arizona Revised Statutes and Titles 3 and 36 of the State Administrative Register prohibit any form of tetrahydrocannabinol.

Arizona Proposition 207 legalized cannabis in 2020, but the plant continues to be listed as a Schedule I drug under these statuses — which affects the legal status of delta 8 THC. Hemp-derived delta 8 THC is qualified as a controlled substance in Arizona.   

What Does the Future Hold? 

In 2020, Arizona legalized the cultivation and possession of recreational cannabis. As the state is moving towards enactment of this law, it may regulate delta 8 as part of its adult-use system. Following the example of other states where recreational marijuana is legal, it’s more likely that Arizona will also legalize delta 8 THC.

 

Is Delta 8 THC Legal Federally?

Delta 8’s legal status remains unresolved federally as the industry navigates a murky landscape. The Farm Bill of 2018 legalized hemp and its cannabinoids for commercial purposes but left states to resolve the legal status of cannabinoids individually. Because federal agencies have no clear response on this topic, some states have decided to ban or restrict this cannabinoid. 

The root of the uncertainty around the legal status of this compound is whether it’s a synthetic compound. In a response letter to the Alabama Board of Pharmacy, the DEA attempted to clarify the legal status of hemp-derived delta 8 THC. In it, the DEA stated that delta 8 is illegal when “synthetically produced from non-cannabis material.” This doesn’t quite address the true nature of delta 8 THC available for sale on the market. 

Because delta 8 is present in trace amounts in hemp, it’s typically derived in a lab from hemp-derived CBD. This process includes the use of cannabis (hemp-derived CBD) and non-cannabis (solvents) materials. Because of this, delta 8 falls in a gray legal area, as it’s not entirely natural, but it’s not fully synthetic either. This process of creating delta 8 THC does give the DEA room to declare it a synthetic substance, but a proper ban hasn’t happened yet. 

The letter also stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.” Based on this definition, delta 8 should be legal because it’s derived from hemp and is present in products in no more than 0.3% delta 9.
