Is Delta 8 THC Legal in Hawaii?

Delta 8 THC is in a gray legal area in Hawaii. The state hasn’t explicitly legalized or banned the compound but does align its legislation with federal law.  

The Hawaii Department of Agriculture recently released Interim Rules to regulate the distribution and sale of hemp products. The rules became effective August 9, 2021, and prohibited the sale of several categories of hemp-derived products. Here’s what’s prohibited in Hawaii:

• Hemp products with a delta 9 concentration that exceeds 0.3% — which is the federally allowed concentration. 
• Sale and distribution of smokable hemp and vaping products.
• Cannabinoid-infused foods and beverages, including gummies. 
• The sale of hemp products for oral consumption, except for capsules, softgels, tablets, and oils.  

Basically, the best products are not allowed for sale in this state. Though a ban on delta 8 hasn’t been issued, you can’t legally buy gummies and pre-rolls that contain any cannabinoid derived from hemp. Registered medical marijuana patients can buy all of these products from a state-licensed medical dispensary. 

What Does the Future Hold?  

Hawaii authorized the production of hemp in 2019, but due to financial struggles, it quickly ended its pilot hemp program. The state always aimed to go the same direction as the federal government when it came to selling and distributing hemp-derived cannabinoid products. 

For now, ∆8-THC remains in a gray legal area in the state and on a federal level. As more states are becoming open towards cannabis legalization, there’s a chance that this compound will be legalized federally and in Hawaii. 

Is Delta 8 THC Legal Federally?

In August 2020, the US Drug Enforcement Administration released its Interim Rule on hemp derivatives, meant to clarify the legal status of hemp cannabinoids. The rule went into effect immediately, but the legal status of ∆8-THC remains unclear. 

The legal status of delta 8 is so complicated because this cannabinoid is not directly extracted from the hemp plant (in most cases). Most products contain delta 8 that’s been isomerized from hemp CBD. Because ∆8-THC is created in a lab from hemp material, it may be considered “synthetic” by the DEA. 

In the Interim Rule, the DEA stated that “synthetic THC” remains a Schedule I controlled substance. The 2018 Farm Bill removed THC from hemp from the definition of marijuana and the scheduled list, but it has no effect over “synthetic THC.” 

Hemp is no longer marijuana, so it doesn’t fall under the authority of the DEA. With its naturally derived delta 8 THC is also legal under the Farm Bill. If ∆8-THC that’s been isomerized from CBD is deemed synthetic, it will fall under DEA’s regulations — which is debatable. For now, this cannabinoid is considered “semi-synthetic” at best and is in a legal gray area federally.
