Is Delta 8 THC Legal in Georgia?

Yes, delta 8 THC is legal in Georgia. The state hasn’t legalized the compound specifically, but it also hasn’t banned its use. 

Georgia legalized hemp in 2019, with the passage of the Georgia Hemp Farming Act or HB 213. The bill formally legalized the commerce of cannabidiol products derived from hemp that contain less than 0.3% delta 9 THC. This law defines hemp similar to federal law.

But, there is a restriction on using THC in food products. Similar to federal law, Georgia doesn’t allow the commercial sale of “food products infused with THC unless approved by the United States Food and Drug Administration.” 

The law excludes hemp from the definition of marijuana and the list of controlled substances. You can buy delta 8 THC products in Georgia if you are over 21 years of age. 

What Does the Future Hold?  

Prior to the bill that legalized hemp-derived products with less than 0.3% delta 9 THC, Georgia prohibited the distribution and sale of products that contain any percentage of THC. The bill redefined hemp products to match federal law.

Is Delta 8 THC Legal Federally?

On a federal level, the legality of delta 8 is unclear. 

We all know that hemp was legalized when Congress passed the Agricultural Improvement Act (Farm Bill) in 2018. The Farm Bill legalized the production of hemp and hemp-derived products with less than 0.3% delta 9 THC. 

At the time, cannabidiol was at the center of the approved cannabinoids. Hemp was de-scheduled and removed from the definition of marijuana, which remains federally illegal. THC derived from hemp has also been removed from the list of controlled substances. 

But, a few years later, loopholes started to become obvious with the appearance of new cannabinoids that don’t fit the main idea behind the legalization of this non-intoxicating plant. Because most products contain ∆8-THC that’s been isomerized from CBD, there’s a risk that it could be considered a “synthetically derived compound.” 

Namely, the Drug Enforcement Administration (DEA) released an Interim Rule on hemp and hemp derivatives that classifies all synthetic THCs as a controlled substance. The Interim Rule doesn’t explicitly define the term “synthetic,” and it’s clear that although it’s not naturally derived, delta 8 is also not synthetic. That is, it’s not made without the use of any cannabis material, which may make this compound “semi-synthetic” at best. 

For now, it appears that there are lots of questions that need answers, so the future of this cannabinoid could change as the DEA releases a new rule.
