Is Delta 8 THC Legal in Michigan?

Delta 8 THC is legal in Michigan but with restrictions. The state recently passed a law allowing the manufacturing and sale of registered delta 8 products only.

Governor Whitmer signed House Bill 4517 to regulate the manufacturing, distribution, and sale of Δ8-THC products. In Michigan, these products are now regulated like other marijuana products. 

Starting October 11, 2021, It’s illegal for businesses to sell delta 8 without proper licensing from the Michigan Marijuana Regulatory Agency. Retailers operating in Michigan must obtain a state license to distribute or sell Δ8-THC. The bill requires mandatory tracking and testing for each product. 

What Does the Future Hold?  

The way Michigan regulated the sale of delta 8 products gives a glimpse of the future of this substance. Most states that run a recreational marijuana program have decided to properly regulate and restrict the sale of hemp-derived Δ8-THC products.

Is Delta 8 THC Legal Federally?

Delta 8’s legality remains unclear at a federal level. 

On September 15, 2021, the Drug Enforcement Administration (DEA) clarified the control status of Δ8-THC in a letter to the Alabama Board of Pharmacy. 

In the letter, the federal agency stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

But, we all know that most Δ8-THC is not obtained directly from the hemp plant but converted from hemp-derived CBD via isomerization. Regarding the synthetic nature of this compound, the DEA stated in the latter that when “synthetically produced from non-cannabis material,” THC is a controlled substance under the Controlled Substances Act. 

The issue with this is that it doesn’t quite answer the question of the true nature of delta 8. This cannabinoid is derived from CBD, which is a natural cannabis material. But, during the conversion process, other non-cannabis materials are involved. 

The very process of creating this compound makes it semi-synthetic, which leaves space for the DEA to ban it. Experts think that a ban is unlikely to happen because the DEA hasn’t approached the delta 8 boom with a ban. 

But even if this substance was not considered controlled, that doesn’t change its legal status in states where it’s banned or restricted. Also, the FDA hasn’t approved its use in food and beverages. The FDA doesn’t seem to be on board with the spread of Δ8-THC in these products, given its recent warning to consumers. All of this contributes to the murky legal status of Δ8-THC.
