Delta 8 THC is likely legal in Mississippi but there are a few things you need to know before you buy.

Following the federal rules, the state also amended its law to exclude hemp-derived THC from the Mississippi list of scheduled substances. In Mississippi, tetrahydrocannabinols do not include hemp or hemp products as regulated by the new law. Seemingly, all hemp derivatives are legal in the state, including delta 8. 

But, the laws are unclear, and there’s no verdict whether Δ8-THC is considered a synthetic cannabinoid. Mississippi, like many states, considers synthetic cannabinoids and THC derivatives illegal. 

What Does the Future Hold?  

Mississippi will likely be one of the last states to legalize delta 8, if that ever happens. The state is strongly anti-cannabis and has recently legalized hemp and hemp-derived products. There’s also a chance that this cannabinoid will be officially banned in the Magnolia State. 

Is Delta 8 THC Legal Federally?

Delta 8 that occurs naturally and is derived from the hemp plant, is legal under federal law. 

On the other hand, Δ8-THC converted from hemp-derived CBD is in a legal gray area. 

This was confirmed in a letter that the Drug Enforcement Administration (DEA) recently sent to the Alabama Board of Pharmacy. The letter stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

Most Δ8-THC products are made with Δ8-THC converted from hemp-derived cannabidiol (CBD). According to the letter, THC that’s “synthetically produced from non-cannabis material” is a controlled substance under the federal Controlled Substances Act. 

Realistically, Δ8-THC falls in between natural and synthetic. This substance is made from a mixture of cannabis (CBD) and non-cannabis materials (solvents), so it can be considered a semi-synthetic substance. As such, it can be listed as a scheduled substance by the DEA, which is unlikely, as the federal agency hasn’t approached it with a ban. 

Although delta 8 is not a controlled substance federally, it’s still considered illegal in many states. Manufacturers infuse it in food and beverages, despite it not being an FDA-approved food additive. The federal agency doesn’t seem to approve the spread of these products, as stated in its recent warning to consumers.

Despite the unclear legal status of this cannabinoid, Δ8-THC is not prohibited under federal law. Many states have regulated Δ8-THC under their hemp or recreational cannabis programs. Hopefully, it will be accepted and properly regulated federally as cannabis becomes more widely accepted for recreational purposes.
