The letter stated: “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

Most delta 8 on the market is converted from hemp-derived CBD. The above definition of legal delta 8 seems to be only for naturally extracted delta 8 THC because the letter states that delta 8 that’s “synthetically produced from non-cannabis material,” is a controlled substance.

From a chemical perspective, delta 8 falls between natural and synthetic. It’s made from hemp-derived cannabidiol (CBD) using solvents and other non-cannabis materials. The very process of converting this substance from CBD makes it semi-synthetic. In the letter, the DEA doesn’t specify whether delta 8 produced from CBD is synthetically produced. 

Although there’s no clear answer about the federal legality of this compound, states have decided to regulate it separately. Recently, the FDA also issued a warning to consumers about the dangers of this substance, which remains unregulated in the majority of states.
