Is Delta 8 THC Legal in New Mexico?

Delta 8 THC is legal in New Mexico. The state allows the distribution and sale of every hemp-derived product that fulfils its adopted rules on manufacture, testing, and labeling.

In New Mexico, you can buy hemp-derived delta 8 products with a less than 0.3% delta 9 concentration. After the adoption of the 2018 Farm Bill, the state passed HB 581 (Hemp Manufacturing Act), which legalized hemp and regulated hemp-derived products. 

Enacted January 2020, the Act defines hemp as any Cannabis sativa plant with a THC (delta 9) concentration of less than 0.3%. One of the great things that New Mexico’s hemp act does is set standards on transportation, processing, and manufacturing of hemp products — meant to increase consumer safety. 

Retailers selling to New Mexico must offer hemp-derived products with less than 0.3% delta 9 THC. This must be clearly visible on a mandatory Certificate of Analysis (CoA) obtained from a certified lab. For brands selling products directly to consumers, the certificate can be provided at buyer’s request.  

What Does the Future Hold?  

New Mexico legalized recreational marijuana, so there’s a chance the state will regulate delta 8 THC under this program. It’s unlikely that the state will ban this compound, given its acceptance of the cannabis plant. But, it may regulate it or impose restrictions in the future. 

Is Delta 8 THC Legal Federally?

Delta 8 THC distributors, online retailers, and users have been facing uncertainty regarding the legality of this cannabinoid. 

Recently, they got some (nonbinding) answers from the Drug Enforcement Administration (DEA). As a response to the question of delta 8’s legality at a federal level by the Alabama Board of Pharmacy, the DEA published this letter. 

The letter confirmed that Δ8-THC derived from hemp is legal under the 2018 Farm Bill. It stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

As you may know, most Δ8-THC infused products you use daily are converted from hemp-derived cannabidiol (CBD). This means there’s a potential for it to be considered a synthetic compound. However, the letter doesn’t provide further conclusions, so things remain in limbo in that area. 

The DEA states in the letter that when “synthetically produced from non-cannabis material,” Δ8-THC is considered a controlled substance under the Controlled Substances Act.

While it is derived from cannabidiol (a cannabis compound), the process of making this substance involves solvents and other non-cannabis ingredients. So, it’s fair to say that this compound could be considered semi-synthetic. 

However, the letter doesn’t clarify if Δ8-THC made through chemical conversion is considered “synthetic.” This is a bit strange because products on the market are infused with delta 8 made from CBD, but the agency doesn’t address that. 

There is a pressing need to regulate this compound so that brands interested in offering quality products can continue their work while providing safety to consumers.
