Is Delta 8 THC Legal in Oregon?

Yes, delta 8 THC is entirely legal and available in the Beaver State. 

Oregon is the first state in the nation to legalize hemp-derived ∆8-THC under a new category of ‘Adult Use Items.’ The state legislature passed House Bill 3000, which defines and merges hemp-derived and marijuana-derived products with high THC levels under the same legal bracket. 

Therefore, products with 0.5mg delta 8, or products containing “intoxicating or artificially derived cannabinoids,” fall under the new category of Adult Use Cannabis Items. For now, the law doesn’t prohibit or restrict the sale of ∆8-THC products — aside from the age restriction. 

But, the bill gives authority to the Oregon Liquor Control Commission (OLCC) to set potency and concentration limits for THC and other intoxicants in hemp products sold to adults. The OLCC and other groups are expected to provide a solution in January 2022.

Is Delta 8 THC Legal Federally?

Hemp-derived delta 8 has been excluded from the Controlled Substances List because the 2018 Farm Bill carved out “hemp” and “THC in hemp” from scheduling. 

But, this cannabinoid is present in the hemp plant in extremely low concentrations — less than 0.1%. To create large quantities, manufacturers use hemp-derived cannabidiol (CBD) and convert it into this molecule. 

Because ∆8-THC is isomerized (in most cases) from CBD, it could be deemed “synthetically derived” by the US Drug Enforcement Administration. 

The Farm Bill doesn’t impact the legality of “synthetically derived tetrahydrocannabinols,” which complicates things because if considered “synthetic,” ∆8-THC would be illegal.  

However, federal law doesn’t clearly define synthetic derivatives, so until further clarification is provided, delta 8’s legality remains murky. While businesses continue to sell legal ∆8-THC, some experts argue that this cannabinoid cannot be federally legal because it’s intoxicating.

According to the US Cannabis Council, there’s no loophole because an intoxicating cannabinoid cannot become legal simply because it’s derived from a non-intoxicating compound.
