Is Delta 8 THC Legal in Louisiana?

Delta 8 THC is legal in Louisiana if sourced from hemp. The state made a bold decision to legalize and regulate Δ8-THC products instead of taking the road to prohibition. 

The new law that opened the path for hemp-derived delta 8 was House Bill 640 passed June 14, 2021. The bill essentially expanded the definition of consumable hemp and legalized food and beverages derived from it. 

The state is in the process of properly regulating Δ8-THC products. Louisiana is offering licenses to anyone interested in processing food products that contain cannabinoids. Interested parties will have to register and get approval from the state Department of Health.  

This means that, unfortunately, only products that have been registered under the state are legal to sell. This bill took effect on August 1, 2021, and amended the ban on edible products set by the previous bill. It also adopted the sale and distribution of consumable hemp products.

Another important update was the legalization of hemp flower, again, only with registered and approved products by the Louisiana Department of Health. 

What Does the Future Hold?  

By regulating CBD and delta 8 THC, Louisiana is taking responsibility for the safety of the products available on the market. This move sets an example for handling new cannabinoids from hemp the proper way. Regulating these products will clear the path for licensed and serious vendors to offer tested products.

Is Delta 8 THC Legal Federally?

The legal status of delta 8 on a federal level is messy, but this compound is likely legal. 

The Drug Enforcement Administration (DEA) recently wrote a response letter to the Alabama Board of Pharmacy. In it, the federal agency stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.” 

The federal agency pointed out that THC is considered a controlled substance when it’s “synthetically produced from non-cannabis materials.” As you may know, most delta 8 products come from isomerized hemp CBD, meaning they are made from cannabis material. However, not entirely. 

This substance is obtained through a chemical process that involves other solvents and acids. So, in essence, this compound is semi-synthetic made from a hemp-derived ingredient. The DEA could deem it illegal as a semi-synthetic, but that seems unlikely. 

And, even if the DEA considered it legal, there are other obstacles like state legality and FDA restrictions that will hinder its overall legality. 

There’s still no official federal prohibition of this compound, but that doesn’t mean it won’t be in the future. The FDA recently published a consumer update warning users that consumption of this compound comes with serious health risks. While it’s unlikely that the DEA will ban this compound, we can see how states are moving towards the direction of legalizing it and providing safety measures around its manufacture.
