Is Delta 8 THC Legal in Missouri?

Delta 8 THC is legal in Missouri. The state passed House Bill 2034 in 2018, which removed hemp and hemp derivatives from the list of controlled substances.

Despite being the second-largest hemp producer in the nation, Missouri’s laws are not too consumer-friendly. Although the sale of Δ8-THC is going without hindrance, the law doesn’t explicitly legalize hemp-derived cannabinoids like CBD or delta 8. 

That said, the state hasn’t explicitly banned or restricted the sale of delta 8 THC products. 

Under state law, only registered patients under the Missouri Hemp Extract Registration Program can buy CBD oil with at least 5% CBD and less than 0.3% delta 9 from state-licensed dispensaries. 

But, the federal Farm Bill removed hemp and THC in hemp from the list of controlled substances. So, if derived from hemp and sold in products with less than 0.3% delta 9, this substance is legal in Missouri. 

What Does the Future Hold?  

Because Missouri is a hemp-friendly state, it’s expected to legalize or at least regulate the sale of hemp-derived Δ8-THC. Like other states, it may regulate it under its hemp or medical marijuana program.

Is Delta 8 THC Legal Federally?

The legality of delta 8 THC remains unclear federally because federal agencies have not explicitly banned or legalized this substance. 

The Drug Enforcement Administration initiated the most recent activity on this front. The federal agency responded in a letter to the Alabama Board of Pharmacy regarding the legality of Δ8-THC. 

In it, the agency stated that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

In addition, they stated that delta 8 “synthetically produced from non-cannabis material,” is an illegal substance under the Controlled Substances Act. 

From this statement, it seems like Δ8-THC is legal federally when derived naturally from hemp and doesn’t contain over 0.3% delta 9 THC. But, in most cases, Δ8-THC is made from CBD, which is a cannabis material. However, there are other ingredients involved in the process of converting CBD into delta 8. 

Therefore, Δ8-THC is derived from cannabis material, but it’s made via chemical conversion. Again, we are faced with the semi-synthetic nature of this compound, which has not been recognized by any federal agency and leaves things murky. Still, federal agencies haven’t approached delta 8 with an immediate ban, we can assume that it’s legal. 

That said, there’s room for its prohibition. For one, the FDA is nowhere near legalizing it, considering its recent warning to consumers about the harmful effects of this substance. Also, many states have decided to ban or restrict the compound regardless of federal guidelines. Because of these things, it’s fair to conclude that the legal status of Δ8-THC remains unresolved federally.
