What Does the Future Hold?  

Montana allows legal cannabis sales starting January 1, 2022. The state is opening up to recreational cannabis, so it may approach delta 8 by incorporating it into the legal recreational cannabis system. Is Delta 8 THC Legal Federally?

The legal status of delta 8 remains murky on a federal level. Federal agencies haven’t explicitly banned or allowed the sale of this substance. 

The most recent discussion on the topic of delta 8’s legality was done by the Drug Enforcement Administration (DEA) in a letter to the Alabama Board of Pharmacy. 

In the letter, the agency goes back to the Farm Bill, stating that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.”

According to the letter, Δ8-THC “synthetically produced from non-cannabis material” is illegal under the Controlled Substances Act. This statement doesn’t address the issue of the true nature of delta 8. Is this substance considered naturally derived or synthetically derived? 

Well, Δ8-THC is made from a cannabis ingredient (CBD) but with the use of solvents and other non-cannabis materials. This makes the compound semi-synthetic because it’s chemically converted and might be considered a Schedule I substance under federal law. 

But, the DEA hasn’t approached the legal status of this substance with a ban, so experts think a ban is unlikely to happen. Regardless, delta 8 is not an approved additive by the FDA and is illegal or restricted in many states in the nation. All of these restrictions and gray areas make its legality murky.
