Is Delta 8 THC Legal in Ohio?

Delta 8 THC is legal in Ohio. The state hasn’t explicitly banned or restricted the sale and distribution of this cannabinoid. 

The 2019 Ohio Senate Bill 57, signed by Governor De Wine on July 30, 2019, legalizes hemp and hemp-derived compounds, including Δ8-THC. The bill is in line with the federal Farm Bill, which classifies hemp as an agricultural commodity and legalizes hemp cultivation, production, and extraction in the United States.

This means that hemp and hemp-based goods are legal if the delta 9 THC content is less than 0.3 percent. The Farm Bill has paved the way for complete, unrestricted access to hemp-derived products in the country. However, some states have elected to make all forms of THC illegal, including delta 8 THC, while Ohio has opted not to do so.

Ohio follows Senate Bill 57, which has removed hemp-derived THCs from the list of controlled substances, meaning it’s legal across the state. 

What Does the Future Hold?  

Ohio regulated all Δ8-THC products derived from marijuana sold within the state’s legal medical cannabis program. For now, no bills have been introduced to ban or restrict the sale and distribution of this compound. Is Delta 8 THC Legal Federally?

Due to a discrepancy between the legislation and a Drug Enforcement Administration (DEA) regulation, the status of Δ8-THC under federal law is unclear. 

All hemp-derived cannabinoids, including Δ8-THC derived from hemp, fall under the federal 2018 Farm Bill’s definition of “hemp.” Hemp is no longer a banned substance and can be manufactured and marketed legally. The issue is, however, with Δ8-THC produced from hemp-derived cannabidiol. 

Is Δ8-THC a controlled substance under federal law when synthesized from hemp-derived CBD? In an attempt to clarify the legal status of this substance on a federal level, in an advisory letter to the Alabama Board of Pharmacy, the DEA stated that delta 8 is an illegal substance when “synthetically produced from non-cannabis materials.” 

Because this compound is obtained in a lab by mixing non-cannabis and cannabis materials, its legal status remains unclear. For now, Δ8-THC is in an unregulated, gray area on a federal level.
