Recently, the Drug Enforcement Agency (DEA) wrote a response letter to the Alabama Board of Pharmacy. In the letter, the agency clarified the status of Δ8-THC under the Controlled Substances Act (CSA). 

Shortly, the DEA explained that “cannabinoids extracted from the cannabis plant that have a Δ9-THC concentration of not more than 0.3 percent on a dry weight basis meet the definition of ‘hemp’ and thus are not controlled under the CSA.” 

This means that Δ8-THC products with less than 0.3% delta 8 THC are legal federally. But, the emphasis here is on “cannabinoids extracted from the cannabis plant.” As we all know, Δ8-THC is isomerized from hemp-derived cannabidiol (CBD), so it’s not directly extracted from the plant. 

On this, the agency stated that THC is considered a controlled substance when it’s “synthetically produced from non-cannabis materials.” In this case, Δ8-THC is made from hemp-derived CBD, which is considered a natural cannabis material. 

However, the manufacturing of this compound also involves non-cannabis materials like solvents. The process of chemical conversion makes this cannabinoid semi-synthetic, which may be a reason for the DEA to classify this compound as a schedule I substance.
